Duties and Responsibilities

Reporting directly to the Executive Director, the incumbent performs the following tasks:

  • Legal strategy and policy development – advising Executive Director and TFV Board of Directors. Highly qualified legal expertise is required at the TFV Secretariat to address the complex questions raised by the legal framework applicable to the TFV. The Legal Adviser is directly accountable for ensuring that the Trust Fund (Secretariat and Board) acts in accordance with the applicable legal framework, including the Regulations of the TFV, and that the decisions of the Trust Fund are based on a sound understanding of the options that this framework provides. The position ensures the availability of in-house legal advice to enable the Trust Fund to take legally sound decisions on strategy and operations under its reparations and assistance mandates on a day to day basis;
  • Legal filings - The Legal Adviser is responsible for preparation and drafting, including coordinating consultations and inputs (in regard) of submissions on behalf of the Trust Fund for Victims to the Chambers, on both reparations and assistance mandates;
  • Functional deputy of TFV Executive Director – The Legal Adviser is expected to work independently, under the direct supervision of the Executive Director. In the absence or unavailability of the Executive Director, the Legal Adviser serves as the functional deputy to the Executive Director. The Legal Adviser may be delegated specific authorities by the Executive Director, including on the supervision of programme management, within the organisational framework of the TFV Secretariat as well as within the framework of authorities delegated by the Board and Registrar;
  • Compliance of TFV programme development and implementation with assistance and reparations mandates as well as with the applicable ICC administrative regulations and rules – The Legal Adviser ensures that TFV funded activities are in compliance with the legal parameters of the relevant mandates, including the scope of activities as well as the engagement of victims (direct and indirect) and other stakeholders. The legal adviser advises the Executive Director on any matters arising from contractual arrangements with donors, strategic partners, implementing partners (TFV intermediaries) and other third parties; in this regard, the legal adviser ensures timely consultation of the ICC Registry’s Legal Office as and when required;
  • Legal representation of TFV and liaison within ICC ­- Where necessary, the Legal Adviser represents the Trust Fund in Court proceedings, internal and external working groups related to the ICC/TFV, as well as in meetings and conferences outside the Court.

Qualifications

Education

  • Advanced university degree in law (international law, criminal law or other field of law related to the mandates of the Trust Fund for Victims). A first level university degree in combination with two additional years of relevant experience is accepted in lieu of the advanced degree.

Experience

  • A minimum of seven years (nine years with a first level university degree) of progressively responsible professional legal work experience relevant to the mandates of the Trust Fund for Victims;
  • Experience, including supervisory roles, of field-based programme design and management in areas relevant to the mandates of the Trust Fund for Victims.

Knowledge, Skills, and Abilities

  • Excellent legal drafting skills;
  • Proven track record of analysing complex legal problems and drafting legal briefs;
  • Proven track record of supervisory and leadership competencies as well as skills and ability to plan, establish priorities and develop clear goals consistent with the work of the Secretariat of the Trust Fund for and the Court as a whole;
  • Good analytical skills and ability to identify legal problems and offer options for solutions;
  • Knowledge of contract development and management (donor agreements, local partners);
  • Team player with ability to establish and maintain good relationships with subordinates and with people of different national and cultural backgrounds;
  • Professional maturity and ability to monitor progress against agreed timelines, to honour commitments and take responsibility for short comings.

Knowledge of Languages

  • Proficiency in one of the working languages of the Court, French or English, is required. Working knowledge of the other is required. Knowledge of another official language of the Court (Arabic, Chinese, Russian and Spanish) would be considered an asset.
