MISSION DESCRIPTION

The jobholder will advise on legal, regulatory and institutional aspects related to all steps of the life cycle of the programmes delegated to the Agency and in particular, the preparation of call for proposals, the evaluation of proposals and the management of grant agreements. S/he will also provide legal counsel and advice on issues related to the management of the Agency and its staff. Under the supervision of the Head of the legal team and the Head of Unit, s/he will coordinate his/her work with the other legal advisers. S/he shall also work closely and collaborate with colleagues of the Agency, the parent DGs and other services of the European Commission and/or executive agencies.

TASKS

More specifically, s/he will be responsible and/or contribute to the following tasks:

Legal analysis, advice and assistance related to programmes' implementation:

  • Answer requests for legal advice from management and operational units on issues relating to the whole programmes' and the ensuing grant agreements' life cycles;
  • Counsel, provide legal advice and assist operational units on issues, including litigations, relating to the admissibility, eligibility and evaluation of proposals;
  • Ensure consistency of draft grant agreements and amendments with the relevant legal framework, and provide legal advice and assistance on any issues related to grants' implementation;
  • Prepare/present training courses to Agency staff or stakeholders on subjects related to programmes' implementation;
  • Participate in inter-service working groups with Commission's services/executive agencies on subjects related to programmes' implementation.

Legal analysis, advice and assistance related to horizontal issues:

  • Deal with or assist with the analysis and legal advice in cases brought before the European Court of Justice, and in preparing replies to European Ombudsman/OLAF enquiries;
  • Deal with or assist with the analysis and legal advice in connection with the Data Protection Regulation and request for access to documents;
  • Follow up and/or support Agency's services with cases relevant for EDES, in particular in situation of insolvency/bankruptcy.

SELECTION CRITERIA

Essential:

  • A level of education which corresponds to completed university studies in law;
  • Professional experience of at least five years acquired in positions related to the profile of the post;
  • Good knowledge of the legal and institutional framework of the European Union, including EU policies and the EU Financial Regulation;
  • Excellent command of English in the technical fields concerned.

Advantageous:

  • Good knowledge of the regulatory framework of H2020, CEF, and the NER300/Innovation Fund or similar funds;
  • Specialisation and/or equivalent professional experience on European Union procurement rules;
  • Experience of working in an international environment;
  • Good command of at least one of the two other Commission working languages (French and/or German).

LANGUAGES

  • English (Proficient C1).
