Senior Counsel, Data Privacy - Europe

We are looking for a Data Privacy attorney to join our Data Privacy legal team. This position will be primarily responsible for providing legal advice for our European operations, and for providing direction and support to our businesses in Asia and Latin America on a broad array of data privacy and security matters typically faced by multi-national consumer products companies (as described in more detail below).

This is a dynamic role that requires a collaborative, agile, focused individual, excited to join a high-performing, IP-driven toy company. The position will be based in Europe and may be located in our offices in the Netherlands or Spain.

RESPONSIBILITIES

The position will focus on data privacy and data security law and compliance. It will involve providing legal counsel to a wide range of business units across the Mattel organization that touch on personal data, including information technology, information security, product development, quality engineering, brand, marketing, e-commerce, and retail.

Key responsibilities include:

  • Provide legal advice to internal stakeholders on compliance with privacy laws and regulations pertaining to personal data processing, security and breach notification rules, as well as company privacy notices, including employee, vendor and consumer data privacy issues.
  • Adapt company’s data privacy and security-related requirements to new regulations and technological advancements in websites, mobile apps, connected products and digital marketing (including social media platforms and interest-based advertising), with particular emphasis on the EU General Data Protection Regulation (“GDPR”) and similar regulations in Asia and Latin America.
  • Participate in cross-functional team meetings focused on IoT/connected products from concept through launch to incorporate privacy–by-design principles. Partner with clients to proactively identify legal issues and enable business strategies in execution.
  • Provide legal advice on privacy risk governance including privacy impact assessments, data processing impact assessments, vendor due diligence assessments and privacy impacting contracts.
  • Draft, negotiate and review data protection contract provisions for a variety of agreements including vendor agreements, agency agreements, media buying agreements and licenses.
  • Conduct legal research on privacy law developments and provide input on legislation.
  • Participate in industry conversations with the Toy Association, Toy Industry of Europe, and other groups.
  • Support privacy and data security work streams for M&A due diligence activities and post-acquisition integration of target operations.
  • Provide client education and training on relevant legal issues.

EXPERIENCE, EDUCATION & SKILLS:

  • Must have law school degree and be qualified to practice law in the Netherlands or Spain.
  • Minimum of 8 years as a practicing lawyer with substantial experience in providing legal advice regarding data privacy and security.
  • At least 5 years’ substantive knowledge of and experience with applicable European privacy and data security laws, including GDPR and EU member state data privacy and security laws.
  • Experience with data protection regulations in Asia and Latin America preferred.
  • CIPP/E or similar certification preferred.
  • Experience with technology agreements, digital properties, and online marketing (including Advertising Technology issues) strongly preferred.
  • Strong analytical, risk assessment and problem-solving skills to be able to quickly understand and effectively support complex business initiatives and compliance projects.
  • Strong drafting, contract and regulatory interpretation skills.
  • Must be able to balance multiple competing priorities and handle a heavy workload with tight deadlines.
  • Discretion, tact, diplomacy, and relationship-skills required to navigate heavy internal client touchpoints.
  • Good organizational and interpersonal skills, attention to detail, precision in communication, and follow-through.
