The Position:

The Legal & Compliance Officer oversees the Compliance Program of DSCH, functioning as an independent and objective body that reviews and evaluates compliance issues/concerns with the aforementioned organization. He/she provides sound legal advice to ensure that all their operations and business activities are carried out in compliance with applicable laws and regulations and that behavior in the organizations meets the company’s ethical standards of conduct and values. He/she also provides advisory services to the Commercial head and other senior management of said organization on legal and related matters.

Roles & Responsibilities:

  • Identification & closing of gaps regarding the organization's Compliance Program, incl. suggesting program improvements and new measures to direct superior and General Management of the organization, as well as supervising and controlling adherence with the Compliance Program of all the officers, employees and collaborators of the organizations which includes, amongst other things, approval workflow oversight and input for compliance relevant activities;
  • Design, implement & review policies and procedures designed to prevent and detect conduct inconsistent with applicable requirements and the company's policies. Provide counseling and resolve questions from internal clients regarding compliance or legal relevant policies and procedures, including Code of Conduct and anti-corruption;
  • Support in the management and implementation of procedures and systems relating to Transfer of Value (ToV), including oversight of data collection and reporting. Liaise closely with DSE responsible person for ToV;
  • Drive education and awareness on compliance and concerned legal matters in the organization, incl. design and execution of Training Programs for company's employees as well as the Communication Program to prevent illegal, unethical, or improper conduct in close coordination with the Human Resources Department and others;
  • Direct all legal and compliance concerns as well as all received allegations of potential violations of policies, procedures and other elements of the Compliance Program to General Counsel of DSE and Head of Compliance Europe, and assist with necessary investigations/audits/inspections as well as ensuring corrective actions are undertaken where appropriate;
  • Provide legal advice to internal clients of the organization, mainly on contractual law (drafting, reviewing and negotiating of contracts), in particular of purchasing, consulting and other service provider contracts (also establishing of templates), but also concerning pricing and reimbursement negotiations with competent Swiss authorities;
  • Work closely with European Legal and Compliance to ensure implementation and adherence to European and Global legal and compliance/ethics initiatives at the local level, and to lead/support in legal and compliance/ethics focused European projects;
  • Review and analyze legislation and regulations affecting the organization and perform an oversight of compliance with the applicable legislation and regulations;
  • Prepare and provide relevant reports to DSE (e.g. Quarterly Legal Report, biannual Non-Compete Obligation List, etc.);
  • Prepare a plan and execute Compliance Monitoring activities pre-approved by the direct superior and the Senior Management of the organization, determine responsibilities/accountabilities and propose corrective actions where necessary;
  • Assisting on data protection relevant matters in consultation with DSE Data Privacy/DPO.

Education & Professional Experience:

  • Travel within Switzerland to e.g., cycle meetings and leadership team meetings;
  • Travel to European Legal & Compliance meetings ~2x per year;
  • University degree in economics/legal or similar;
  • 5-8 years experience in the pharma industry, with at least 2 years of experience directly in Legal and/or Compliance functions;
  • Excellent language skills: German and English are a must, French is a benefit;
  • Strong personal integrity and ethics;
  • Ability to communicate clearly and positively influence others at all levels of the organization;
  • Successful experience in cross-functional collaboration;
  • Passion for innovation and compliance;
