Provides effective legal counsel or support in legal activities for OpCo, Segment, or Group. Counsel activities include training, negotiations, litigation, reviews, as well as the creation and maintenance of legal housekeeping processes, and the management of outside counsel. Requires Juris Doctor degree (or local country equivalent) and admittance to local legal body (e.g., state bar or country bar).

The successful candidate will serve as the lead attorney for all of Water’s operations in Europe, Middle East and Africa (EMEA) and will also serve as the point attorney for the global operations of Hach, headquartered in Loveland, Colorado, and OTT, headquartered in Germany. As the point attorney for these businesses, he or she will also be an active member of their leadership teams, responsible for advising on both tactical and strategic issues with legal implications. In broad terms, the position encompasses two major areas of responsibility:

  • set and implement legal strategy, policy and processes in alignment with the Water businesses’ near and long-term objectives; and
  • manage a wide variety of daily work in all substantive legal areas.

The incumbent would mentor dotted-line Legal & Compliance colleagues sitting at EMEA offices. The position will report directly to the Water Platform VP & GC and will also have accountability to the presidents of Hach and OTT. The position will be based in Dusseldorf or Berlin, Germany.

Core Responsibilities

Set and implement legal strategy, policy and processes. In close consultation with the business and other functional leaders at Hach and OTT, this position is expected to:

  • Devise and implement legal strategies to enhance our businesses’ competitive advantages (including in the areas of marketing, sales, intellectual property, software, strategic sourcing, labor and employment, and wherever else well-developed and executed legal strategies can provide an advantage);
  • Drive standard processes and work product for a wide variety of commercial contracts and tenders;
  • Help the businesses implement new go-to-market strategies in highly-compliant ways that preserve or improve margins while remaining attractive for our third-party business partners;
  • Effectively implement and execute standard work in accordance with Danaher’s policies in areas such as subsidiary management and corporate governance, records management, and privacy;
  • Supervise the team of associates in EMEA responsible for Trade Compliance, and ensure that the legal and corporate expectations for these programs are being well-executed;
  • Conduct compliance-related investigations as needed and help remediate identified issues;
  • Deliver training and advice to drive best practices for compliance and risk management;
  • Provide astute business counsel to the Hach and OTT leadership teams;
  • Prepare and work within annual legal budget;
  • Manage wide variety of daily work. Responsible for full scope of hands-on legal work and work-product creation; coordinate and collaborate with other Danaher legal team members (both Water and Corporate) on cross-border issues and specialized legal work; retain and effectively supervise outside counsel as needed. The position will carry out these responsibilities in at least the following areas:
    • Contracts (customers, channel partners, vendors, public tenders, open innovation partners, etc.);
    • Competition law, comparative advertising, brand management;
    • Software, privacy, and data security;
    • EU environmental and regulatory compliance, including trade compliance (imports/exports);
    • Acquisition diligence and post-closing integration;
    • Product and performance liability;
    • Patents and trade secrets;
    • Labor and employment;
    • Litigation;
    • Provider leadership, mentorship and development of other associates.
  • Lead and develop the EMEA associates responsible for trade and other regulatory compliance work;
  • Collaborate with and mentor the associates in our global contracts team (based in the U.S.), who will assist our EMEA operations as needed with the ebb and flow of transactional work;
  • Train and mentor all internal associates whose work has legal, integrity and compliance implications, including our associates in Sales & Service, R&D, Product Development, Marketing, IT, HR, and Finance;
  • Educate business leadership on the appropriate use and “leverage” of in-house counsel.

Skills and Qualifications

Work experience

  • Minimum of 10 years of experience as a practicing attorney;
  • Law firm experience required, with mix of law firm and in-house experience preferred;
  • Legal expertise in at least one discipline (e.g., transactions, commercial litigation, regulatory) but with solid and wide experience — i.e., has personally handled a broad range of legal issues, including substantial work drafting, reviewing and negotiating contracts, and experience in the areas of competition law, software law, intellectual property, regulatory compliance, labor & employment, and acquisition due diligence & integration;
  • Comfortable (with appropriate humility) in handling or at least issue-spotting legal issues outside the EU, most importantly those arising in N. America.

Education and License Requirements

  • Law degree from a top tier law school;
  • Active, licensed lawyer in good standing in Europe (preferably Germany or the U.K.);
  • Leadership Skills and Personal Trait Profile;
  • Ability to build and maintain the confidence of senior management and to build relationships necessary to work in a complex, cross-functional organization;
  • Excellent organizational skills and attention to detail;
  • Ability to handle a mix of short-term urgent projects while also driving critically-important and sometimes complex long-term projects;
  • Thrives in a fast paced, high demand environment;
  • Accomplishes by doing — this is a hands-on position;
  • Excellent judgment and strong business acumen; able to rapidly learn the businesses’ competitive drivers;
  • Kaizen mentality — stays on top of daily work but always strives to find better ways of accomplishing more;
  • Unquestioned integrity — adheres to the highest values in decisions, conduct, and work with others;
  • First leadership experience will be a plus; basic knowledge of common law principles desirable.
